Policy 505.2 - Interviews With Students

INTERVIEWS WITH STUDENTS


District personnel shall have the authority to conduct investigations and to question students pertaining to infractions of school rules and district matters whether or not the alleged conduct is a violation of the criminal law. The students' parents need not be contacted. For the purposes of this policy, the school juvenile court officer and child abuse investigator shall be considered a school employee.

A professional district employee or parent or guardian shall be present throughout the interview, except where the Code of Iowa specifically states otherwise. Non-district personnel may not interview a student in school, unless the building principal or the principal's designee grants permission.

It should not normally be necessary for law enforcement officials to conduct any investigation on school premises pertaining to criminal activities unrelated to the operation of the schools. Only when a demonstrated necessity exists shall law enforcement officials be allowed to conduct such an investigation. Should law enforcement show just cause for conducting an investigation on school property, they will be asked to make parental contact prior to interview being conducted. In situations such as child abuse investigations, the principal will determine whether the student should be interviewed independently from the student’s parents. If law enforcement is unable to make contact, school personnel will attempt to contact parents to make them aware of the situation.

Generally, prior to granting a request for a student interview with non-district personnel, the principal will attempt to contact the parents to inform them of the request.
